1. Acceptance of Terms

By accessing or using the cmfy.cloud service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and cmfy.cloud. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Service Description

cmfy.cloud provides a cloud-based platform for running ComfyUI workflows. Our Service allows you to:

  • Submit ComfyUI workflow JSON files for execution on GPU-equipped servers
  • Receive generated outputs (images and other media) via webhook or API retrieval
  • Monitor job status and manage your workflow queue
  • Access usage analytics and billing information

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Responsibilities

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials and API keys
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You may not share your API keys or allow others to access your account. You are solely responsible for any activities conducted through your account, whether or not you have authorized such activities.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Generate, distribute, or store illegal content
  • Create content that depicts minors in a sexual or exploitative manner
  • Generate non-consensual intimate imagery of real people
  • Create content intended to harass, threaten, or incite violence
  • Produce fraudulent or deceptive content designed to mislead others
  • Infringe upon the intellectual property rights of others
  • Attempt to circumvent usage limits or security measures
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service for any purpose that violates applicable laws or regulations

We reserve the right to investigate and take appropriate action against anyone who violates this policy, including suspending or terminating accounts and reporting violations to law enforcement.

5. Billing and Payment

Pricing

Our Service operates on a pay-as-you-go model. Current pricing is available on our pricing page. Prices are subject to change with notice.

Prepaid Credits

You must maintain a positive credit balance to use the Service. Credits are purchased in advance and deducted as you use the Service based on compute time consumed.

Billing

  • All charges are in US dollars unless otherwise specified
  • Credits are non-refundable except as required by law
  • Unused credits do not expire while your account remains active
  • Subscription fees (if applicable) are billed in advance on a monthly basis

Failed Jobs

You will not be charged for jobs that fail due to our system errors. Jobs that fail due to invalid workflows, unsupported operations, or user errors may still incur charges based on compute time consumed before the failure.

6. Intellectual Property

Our Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by cmfy.cloud and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

Open Source Components

The Service utilizes open source software, including ComfyUI and various node packages. These components are subject to their respective open source licenses.

7. User Content

Ownership

You retain ownership of the workflows and input data you submit to the Service ("User Content"), and you own the outputs generated from your workflows.

License

By submitting User Content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service. This license terminates when you delete your content or close your account.

Responsibility

You are solely responsible for your User Content and ensuring you have all necessary rights to submit it. You represent and warrant that your User Content does not violate these Terms or infringe on any third party rights.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CMFY.CLOUD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, error-free, or secure
  • The results obtained from the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • Any errors in the Service will be corrected

10. Termination

Termination by You

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

Termination by Us

We may suspend or terminate your account at any time, with or without cause or notice, including but not limited to:

  • Violation of these Terms or our Acceptable Use Policy
  • Non-payment of fees
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

Effect of Termination

Upon termination, your access to the Service will be disabled and your data may be deleted. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

If you do not agree with the modified Terms, you must stop using the Service and terminate your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection based on venue or inconvenient forum.
